The parties have not conferred on the Defendants' motions to compel [109, 110, 111, 115, 117], and a review of the back-and-forth correspondence showed that there could be a substantial narrowing of the disputes if the parties would just drop the sniping tone, stop trying to impose pre-conditions before conferring, and simply confer. The parties' counsel shall meet and confer by 05/23/12. By the close of business on that date, the parties shall submit a joint letter to the Court reporting on whether the parties conferred. If the conferral has not taken place, then the Court will simply pick a date and time for the conferral. In open court, the Court ruled on various aspects of the motions, and the motions are granted in part and denied in part. On or before 05/16/12, Plaintiff shall supplement the interrogatory answers by identifying each and every allegedly defamatory statement, and doing so without incorporating by reference some other document that has statements that are not alleged to be defamatory. Once the allegedly defamatory statements are identified, then there will be no need for many of Defendants' requests-to-admit. Plaintiff must also provide damages discovery and disclose discovery as to the accuracy of the metals testing. As further explained in open court, many of Defendants' document requests are too broad, including seeking every document produced in any other litigation involving metals testing.
